can some one be sectioned when under the influences of drugs?
for there safety and others
Answers:
Depends what section you are looking under! Sec 136 allows a person to be sectioned by a police officer that is likely to be a harm to themselves or the public whilst possible suffering from a mental illness. This then means the person is taken to the nearest mental health unit and can be kept there for upto 72 hours to be assessed by a doctor and a qualified social worker. THis means that as the police aren't experts in the area of mental illness that someone could be sectioned, but you will generally find that once assessed they are toild they have drug induced psychosis and are released as this isn't mental illness.
Dont see why not
Yes if there are mental health issues that mean that the person is a danger to themselves or others
Yes if they are deemed to be a danger to themselves or to others then than can be sectioned under the mental health act to a place of safety
only if they are mentally ill, or they get arrested
