My dentist tries to collect money through collection agency after he did malpractice.?

He distroyed my teeth and I reported him to California Dental Board a year ago. Now he is asking for money. I spent 5 time more money to fix his malpractice. What should I do ? I will not pay anything for his malpractice. We disputed about his practice and he know this. But he is really unethical and not professional asking for money for that now. He is insane. What should I do if he send this to a collection agency.

Are you saying that you sued him in Civil Court and won a mal-parctice judgment against him?
Or, are what you saying is that you simpley are not satisfied with the work he performed?
If the later is the senario then you can't scream mal-practice!
You must prove mal-practice.
It's my judgment that you are simpley not satisfied with the work performed by the Dentist otherwise you wouldn't be getting billed.
If there was mal-practice and or gross neglegence then for sure you would have aquired a tort lawyer and this matter would be resolved in the proper fourm and not in yahoo Question and Answers!

The Dental Board can advise you what to do. Also inquire at the American Dental Association what you should do
How were things resolved at the state board? If they found against him, I'd suggest you consult a lawyer to see what your rights are about not paying.

Unfortunately, the dentist never gave you a guarantee that your treatment would be successful and yet, I am sure that you signed an agreement to pay all related charges. It sucks, but that's the legal reality of it at this point.

Ultimately, to collect from you, he may need to get a judgement against you. This would mean a court appearance. If you can document the amount of money you spent to undo the damage, maybe the judge in that court would see things your way.

Consulting with a lawyer was good. However,we tried to contact and met many lawyers. Most of them think this is too small and many don't really want to be involved in malpractice thing. It is suck..so we waisted one year and the laywer said that it is valid onlly for one year so now I am kind of gave up a legal option unless they bother us again. I don' think there are many good lawyers who is willing to take this case. Anyway,what if they report this to credit agency to destroy my credit score? Can I contact credit agency and explain this with a letter? Maybe can I send the copy of what I sent to Dental Board?

The first thing you should remember is you need to communicate. I know it sounds basic, but people - even collection people - hate to be ignored.

Tell the collection agency you are disputing the charges, then send them a letter to that effect. Sorry to ask, but is English your first language? You might need someone to write the letter for you. Don't say you won't pay the bill- say you want to settle a dispute before you pay.

This should stall any collection action and keep your credit clear for now.
